1. Agreement to Terms
By using the transportation and logistics services of Transport Secure Express ("Company,"
"we," "us"), you ("Customer," "Consignor," "you") agree to be bound by these Terms and
Conditions. Please read them carefully before booking any service.
2. Service Description
Transport Secure Express provides road transportation and logistics services including:
- Full Truck Load (FTL) transportation
- Part Load / Parcel services
- Express Delivery services
- Door-to-Door delivery
- Contract Logistics
3. Booking and Confirmation
- Bookings can be made via phone, WhatsApp, email, or our website
- A booking is confirmed only upon receipt of written/verbal confirmation from our team
- Accurate information about cargo weight, dimensions, and nature must be provided
- False or misleading information may result in additional charges or service refusal
4. Pricing and Payment
- Rates are quoted based on information provided by the customer
- Additional charges may apply for waiting time, detention, handling fees, or route
changes
- Payment terms are as agreed at the time of booking
- For credit customers, payment is due as per the agreed credit terms
- Late payments may attract interest charges
- GST and other applicable taxes are extra unless stated otherwise
5. Customer Responsibilities
The customer is responsible for:
- Proper packaging and labeling of goods
- Accurate declaration of cargo contents, weight, and value
- Ensuring goods are ready for pickup at the agreed time
- Providing necessary documentation for transportation
- Ensuring cargo does not contain prohibited or illegal items
- Having authorized personnel available for pickup and delivery
6. Prohibited Items
We do not transport:
- Illegal drugs and narcotics
- Weapons, firearms, and explosives
- Hazardous materials (without proper documentation)
- Live animals (unless specifically arranged)
- Currency, valuable documents, jewelry (unless declared and insured)
- Any items prohibited by law
7. Delivery and Transit Times
- Estimated delivery times are provided in good faith but are not guaranteed
- Delays may occur due to weather, road conditions, traffic, or circumstances beyond our
control
- We are not liable for consequential damages due to delays
- The customer will be notified of any significant delays
8. Loss and Damage Liability
- Our liability for loss or damage is limited to the declared value or market value,
whichever is lower
- Maximum liability without declared value is as per the Carriage by Road Act, 2007
- Claims for visible damage must be noted on the POD at the time of delivery
- Claims for concealed damage must be reported within 24 hours of delivery
- Claims must be submitted in writing within 7 days of delivery
- We are not liable for damage due to improper packaging by the customer
9. Insurance
- Basic transit insurance is included in our services
- For high-value goods, additional insurance is recommended
- The customer may opt for comprehensive cargo insurance at additional cost
- Insurance claims are subject to the terms of the insurance policy
10. Cancellation
- Cancellations must be communicated at least 24 hours before scheduled pickup
- Late cancellations may attract cancellation charges
- Refunds for prepaid bookings will be processed within 7-10 business days
11. Force Majeure
We shall not be liable for delays, losses, or damages caused by events beyond our reasonable
control, including but not limited to natural disasters, strikes, riots, government actions,
epidemics, or accidents.
12. Dispute Resolution
- Any disputes shall first be attempted to be resolved amicably
- Unresolved disputes shall be subject to arbitration in Hooghly, West Bengal
- These terms are governed by the laws of India
- Courts in Hooghly, West Bengal shall have exclusive jurisdiction
13. Amendments
We reserve the right to modify these Terms and Conditions at any time. Changes will be
effective upon posting on our website. Continued use of our services constitutes acceptance
of the updated terms.
